In a move aimed at simplifying the U.S. immigration process for highly skilled professionals, the U.S. Citizenship and Immigration Services (USCIS) has revised its guidelines for the EB-1 visa category, effective immediately. The changes make it easier for applicants to demonstrate "extraordinary ability" in fields such as science, arts, education, business, and sports. This update, announced last week, allows applicants to use team-based achievements as valid evidence of extraordinary ability, broadening the qualifications for the EB-1 visa. Experts note that while this is a positive development for those pursuing the EB-1 visa, it may not significantly impact individuals applying under the EB-2 and EB-3 categories. “The revised policy is good news for Indians considering alternatives to the EB-2 and EB-3 routes for obtaining green cards. However, it will only benefit EB-2 and EB-3 applicants if they can meet the extraordinary ability criteria required for EB-1,” stated Vivek Tandon, Founder and CEO of EB 5 BRICS. The EB-1 visa, also known as the Extraordinary Ability Permanent Residence visa, provides a pathway to permanent residency in the U.S. for foreign nationals with exceptional skills. The visa also extends to the applicant’s spouse and children, enabling them to apply for green cards.

Opportunities for Indian Professionals

The updated guidelines emphasise team-based accomplishments, offering significant advantages to Indian professionals engaged in collaborative projects. Contributions to team-based research, technological advancements, and international recognition in fields such as AI or software development can now be used as qualifying evidence for the EB-1A subcategory. Similarly, athletes on internationally recognized teams, such as those representing cricket squads in major competitions, can leverage their team achievements to strengthen their applications. Researchers whose scientific contributions are acknowledged at an international level will also find it easier to meet the criteria for the EB-1A visa.

Costs for Filing an EB-1 Visa

The cost to file the Form I-140 Immigrant Petition for Alien Worker is $700 (approximately ₹58,779). While this is generally covered by the sponsoring U.S. employer, self-petitioners applying under the EB-1A category will need to bear the cost themselves. As U.S. immigration policies continue to evolve, the recent updates from USCIS present new opportunities for Indian professionals seeking permanent residency in the United States, offering a more streamlined path for those able to demonstrate extraordinary ability.
