On October 1, 2024, this Study Permit Pilot Project got underway. Participants in this program may include those who have been denied a study permission by the IRCC.The student and the IRCC must agree and deny the study permit application in order for the pilot project to proceed. Judges can decide on leave and judicial review simultaneously without holding a hearing because to this agreement.It should be mentioned that the Study Permit Pilot Project does not permit affidavits, which are usually used to present fresh evidence.Applicants must use the court's e-filing system to electronically submit their documents. Although participation in the initiative is free, there is a $50 cost to submit an application for court review and leave.Students who apply for a study visa from within Canada have 15 days from the date of rejection, whereas those who apply from outside the country have 60 days.
How to Apply for the Study Permit Pilot Project?
Using Form IR-1, applicants must submit an application for leave and judicial review, making sure to mention the pilot project three times in the application.First, above the headline of Form IR-1, write "SIMPLIFIED PROCEDURE – STUDY PERMIT PILOT PROJECT" in bold characters.Second, "The Applicant consents to proceed under the SIMPLIFIED PROCEDURE – STUDY PERMIT PILOT PROJECT" should be written on Form IR-1, just above the signature line. The Study Permit Application Number and Unique Client Identifier that were obtained from the IRCC must be included in Form IR-1.Thirdly, applicants should mention "SIMPLIFIED PROCEDURE – STUDY PERMIT PILOT PROJECT" under "handling instructions" during the e-filing process.
